        A JURY CASE.-ALLEGED SLANDER. Edward Osborne, selector, of Dumbalk, sought to recover the sum of £19, damages for alleged slander on 27th September, from - Gooley, of the same place. Mr. Morgan appeared for tile plaintiff, and Mr. Gaunson for the defendant. The defence was that the words com- plained of were never uttered, and, if so, were only abuse. Edward Osborne, the plaintiff, stated that he was a farmer and selector at Dum- balk. Was engaged by defendant to go to Foster, and drive some cattle from there. Mr. Gooley bought the cattle, and he (witness) took charge of them at Yarram, Gooley handing him the receipts on the 20th September, which he afterwards returned at Foster. Got the cattle home, and put them in the paddock, the fence being faulty. Defendant came home on the 22nd of September, covered with mud. Seeing his pockets inside out, witness asked him for the receipts, which could not be found. On the 27th they were branding cattle, and were going to brand a calf, when witness said it was a stranger. Defendant said he "did not care a d---- if they were all strangers," and "You're a thief and a b--- scoundrel, and stole my receipts and cattle; you know b----- well where my cattle are, but I'll fix you up." The two brothers Campbell, Goodall, defendant and witness were present at the time. It was well known in the district that the cattle were lost. In cross-examination witness said that on account of this incident several of his friends had shunned lthim, and he had been unable to get a stroke of work since. Alexander McDonald, George Goodall, Kenneth Campbell, and Alex. Campbell gave corroborative evidence. The defendant stated plaintiff asked him about the receipts at Yarram, saying that to could take better care of them. Gave hit all but one receipt, which he never got back, and on asking him for them back again on his return home, Osborne said he had returned them at Foster, which was not correct. With reference to the branding incident only told Osborne to clear out. The jury then retired, and on returning gave a verdict for £5 for the plaintiff and costs.
